About SagaRun and eligibility

SagaRun turns walking and running distance into progress through illustrated stories. You may play as a guest. An optional account enables progress backup and recovery when synchronization succeeds. Features may depend on a compatible device, Apple Health permissions, connectivity, and the version of the app you use.

SagaRun is not directed to children under 13. You must have the legal capacity to accept these Terms, or permission from a parent or legal guardian where applicable law requires it. Keep your sign-in credentials secure and provide accurate information when using account services.

If you download SagaRun through the Apple App Store, Apple's applicable usage rules also apply. If we make SagaRun available through another store, that store's applicable rules will apply to downloads and purchases made there.

Safe use and workout accuracy

SagaRun is an entertainment and general fitness companion. It does not provide medical advice, diagnosis, treatment, or an assessment of whether exercise is safe for you. Choose an activity and distance appropriate for your circumstances and seek professional advice if you have concerns about exercising.

Pay attention to traffic, your surroundings, and treadmill safety. Stop exercising if you feel unwell. Story goals are optional entertainment and should never take priority over your safety. Do not interact with the screen while doing so would be unsafe.

Distances and progress depend on the information supplied by your device, Apple Health, and compatible workout apps. Calibration, permissions, synchronization, and recording errors can affect accuracy. Practice or simulated progress does not independently verify exercise. We do not guarantee a particular fitness outcome or uninterrupted, error-free measurement.

Limitations of use

You must not, except where applicable law expressly permits:

• Copy, modify, redistribute, commercially exploit, decompile, or reverse engineer SagaRun or its software and materials without permission.
• Remove copyright or proprietary notices, transfer the app's materials to others, or mirror them on another server without permission.
• Abuse or disrupt our networks, bypass access controls, interfere with other users, or misuse credentials.
• Transmit harassing, obscene, fraudulent, unlawful, or rights-infringing material, or send unauthorized advertising or spam.
• Collect another person's data without a lawful basis or consent where required, or infringe their privacy or intellectual property rights.

Intellectual property

SagaRun's software, stories, illustrations, audio, designs, branding, and other materials are owned by or licensed to Suphasit Thongniam. We grant you a limited, personal, non-exclusive, non-transferable license to use the app and its content for your own non-commercial use, subject to these Terms and applicable store rules. This is a license, not a transfer of ownership.

This license may end if you breach these Terms or your right to use the service is terminated. Statutory rights and exceptions that cannot lawfully be excluded remain unaffected.

Your content and feedback

You retain ownership of content you submit, including written feedback. You must have the rights needed to provide it. You grant us a non-exclusive, royalty-free license to store, copy, and use that content to operate, support, and improve SagaRun, consistent with the Privacy Policy.

Private feedback is not a public post. We will obtain separate permission before publishing an identifiable testimonial or using your name or feedback in advertising. Deleting your account ends this license except to the extent retention is legally required or the content has been made genuinely anonymous.

Accounts, progress, and deletion

Guest progress is stored on your device and is not an account backup. Removing the app, losing your device, or clearing its data may lose local progress. Recovery on another installation requires an account and a successful backup; offline changes may remain pending until the service can synchronize.

To delete an account, open Your account in SagaRun, choose Delete account, and verify a linked sign-in method. The Privacy Policy explains what is deleted and the limited records that may remain. Deleting an account or the app does not cancel any separately purchased store subscription.

Free features and subscriptions

The current first release offers its initial story without a paid subscription. A free download or account does not authorize us to charge you. If paid content, a subscription, or a free trial is offered in the future, the price, billing period, included features, and trial conditions will be disclosed before you confirm a purchase. Our Subscription Terms will apply to such an offer.

Updates and service changes

We may release updates or change features and content. Updates are downloaded and installed according to your device and store settings. You may need a current app version to maintain compatibility. We may amend these Terms by publishing an updated version and revising the date. We will give notice of material changes through the app, website, or an available account contact method, and obtain consent or provide advance notice where law requires it. Changes apply from the stated effective date, subject to applicable law.

Liability and accuracy of materials

To the extent permitted by law, SagaRun and its materials are provided as available and as is, without warranties of merchantability, fitness for a particular purpose, non-infringement, or guaranteed accuracy. Stories are fictional and general information is not a substitute for professional advice.

To the extent permitted by law, Suphasit Thongniam and his suppliers are not liable for indirect or consequential losses arising from use of or inability to use SagaRun, including loss of profits, revenue, opportunities, goodwill, or data. Some jurisdictions do not permit these exclusions. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded, including liability for fraud or any other non-excludable liability.

Third-party links and services

External sites, sign-in providers, stores, and workout services have their own terms and privacy practices. A link is not an endorsement. We do not control third-party content or guarantee the availability or accuracy of those services. Review their terms before using them.

Notice regarding Apple

These Terms are between you and Suphasit Thongniam, not Apple Inc. Apple is not responsible for SagaRun or its content and has no obligation to provide maintenance or support for the app.

If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the app purchase price, if any, in accordance with applicable requirements. To the maximum extent permitted by law, Apple has no other warranty obligation; other claims, losses, or expenses attributable to such failure are our responsibility.

We, rather than Apple, are responsible for addressing claims relating to SagaRun, including product liability, legal or regulatory compliance, consumer protection, and third-party intellectual property claims. You must comply with applicable third-party agreements and App Store usage rules.

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated by it as a terrorist-supporting country, and are not on a U.S. Government list of prohibited or restricted parties.

Termination, severance, and governing law

We may suspend or terminate your account or access for a breach of these Terms, with written notice where practicable and as required by law. You may stop using the service at any time. Mandatory refund or other consumer rights remain available.

If any provision is invalid or unenforceable, it is severed only to that extent and the remainder continues to apply. These Terms are governed by the laws of Thailand, and disputes are subject to the competent courts of Thailand, except where mandatory law gives you other governing-law protections or rights to bring a claim elsewhere.
